Terms of Service

License Terms

NOMARK is distributed under two licenses:

• NOMARK Engine (@nomark-ai/engine) — Apache License 2.0. Free to use, modify, and distribute.
• NOMARK Pro (@nomark-ai/pro) — Business Source License 1.1 (BSL). Free for non-production use. Production use requires a paid license. Converts to Apache 2.0 after 4 years.

Acceptable Use

You agree to use NOMARK services in compliance with applicable laws. You may not:

• Attempt to reverse-engineer NOMARK Pro beyond what the BSL permits
• Use the service to store or transmit malicious content
• Circumvent usage limits or authentication mechanisms
• Resell access to NOMARK services without authorization

Service Availability

Local tier operates entirely on your device — availability is your responsibility. Cloud services (Free, Pro, Team) are provided on a best-effort basis without SLA. Enterprise plans include a negotiated SLA with uptime commitments.

Data Ownership

You own your preference data. NOMARK does not claim ownership of your signal entries, meaning maps, or any other user-generated content. You can export or delete your data at any time.

Limitation of Liability

NOMARK is provided “as is” without warranty of any kind. To the maximum extent permitted by law, NOMARK shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

NOMARK's total liability for any claim arising from these terms shall not exceed the amount you paid for the service in the 12 months preceding the claim.

Modifications

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
